Morris County's Interim Draft Wastewater Management Plan was submitted to the NJDEP on December 31, 2009. The draft plan is subject to amendments and revision. Updated documents will be posted in our Scribd.com library.

The plan consists of a cover sheet, completed Application Form*, chapters for each of the 39 municipalities, and sewage treatment plant facilities information. (For the Highlands Planning Area Conforming municipalities, the Highlands Council will be working with them to create their chapters and maps. Once completed, these chapters will be included in the Draft Wastewater Management Plan.)

Each municipal narrative includes a description of the municipality and its infrastructure, an existing zoning build-out analysis, a capacity analysis of each sewage treatment facility, septic capacity analysis by subwatershed (HUC 14), build-out/capacity analyses (surplus/deficit), and three maps.

P.L.2011, CHAPTER 203 enacted January 17, 2012
The law requires that wastewater service area designations and sewer service area designations remain in effect and not be withdrawn for a period of 180 days (July 15, 2012) after its enactment, or such longer time that the Commissioner of Environmental Protection may determine. However, the extension period would not exceed two years, as this bill would expire, in its entirety, two years after its date of enactment, which is January 17, 2014.

Required Municipal Ordinances: The rules require that each municipality adopt the following ordinances, where applicable, in order to have a valid chapter in the County Wastewater Management Plan. The following model ordinances are provided as samples and may be modified as long as the ordinance meets the requirements of the Water Quality Management Planning Rules.

Optional Municipal Septic Management Ordinances: The Water Quality Management Planning Rules require municipalities to demonstrate that areas to be served by individual subsurface sewage disposal systems (septic systems) are subject to a mandatory maintenance program, such as an ordinance, which ensures that all individual subsurface sewage disposal systems are functioning properly. This shall include requirements for periodic pump out and maintenance, as needed. (See N.J.A.C. 7:15-5.25(e)3.) While municipalities with areas outside a Sewer Service Area are required to develop a plan or program, the adoption of an ordinance is optional.
